New regulations regarding energy performance certificates have recently come into force, which were adopted several years ago but have only now entered into force. New regulations – when did they come into effect?
The provisions regarding the obligation to have an energy performance certificate were adopted in the 2014 Act, but only on April 28, 2023, new regulations were introduced that affect building owners, landlords and investors. From this point on, certificates are required in many situations where the building is sold, rented or put into use.
The new regulations aim to improve the energy efficiency of buildings in Poland and increase awareness of energy consumption. This change is part of efforts to promote more sustainable construction and reduce CO₂ emissions.
When do you need to have an energy performance certificate?
From April 2023, building owners, investors and property managers are obliged to have an energy performance certificate in the case of:
- sale of a building or its part, e.g. an apartment,
- property rental
- commissioning of a newly constructed building.
This obligation applies to both residential buildings and commercial premises, as well as public buildings with a usable area exceeding 250 m².
What are the benefits of having a certificate?
The obligation to have an energy performance certificate may seem like an additional formality, but it has many benefits:
- Lower operating costs: The certificate provides information about the building's energy efficiency, which helps identify areas requiring modernization. Thanks to this, you can make changes that will reduce your energy bills.

How to get an energy performance certificate?
The certificate can be prepared by authorized specialists. Building owners should provide appropriate documentation, including information on building insulation, heating systems and energy consumption. The certificate can be obtained in paper or electronic form and is valid for 10 years.
If the building has been modernized, such as replacing windows, insulating the building or replacing the heat source, the certificate becomes invalid and requires renewal.
